We, Curomates Enterprise Private Limited ("Curomates"), operate internet-based mobile applications, referred to as "Moodlift" or "Curomates" interchangeably in this document. The terms "we," "us," and "our" include Curomates Enterprise Private Limited and its application Moodlift. Similarly, "you" and "users" refer interchangeably to individuals accessing or using our services.

The term "Curomates" or “Moodlift” encompasses its present and former employees, officers, directors, agents, successors, assigns, subsidiaries, divisions, affiliates, and associated corporate entities.

When you visit our website https://www.curomates.com/ or www. Moodliftapp.com (the "Website/s"), or more generally, use any of our services (the "Services", which include the Website and Mobile Applications ‘Curomates’ and ‘Moodlift’, we appreciate that you are trusting us with your personal information. We take your privacy very seriously. In this privacy notice, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy notice that you do not agree with, please discontinue use of our Services immediately.

 

This privacy notice applies to all information collected through our Services (which, as described above, includes all our websites and apps), as well as, any related services, sales, marketing or events. By using our websites or apps, or our services in any way, you agree to the Terms of Service, Privacy Policy and Refund Policy in full. When we mention our “website”, “app” or “platform” here, we refer to all our websites, apps and services, and may use these terms interchangeably.


We automatically collect certain information when you visit, use or navigate the platform, such as IP address, log and usage data, device data, location data, etc. We may collect limited data from public databases, marketing partners, social media platforms, and other outside sources. We process your information for purposes based on legitimate business interests, the fulfilment of our contract with you, and compliance with our legal obligations. We may use your information to facilitate account creation and login processes, to post testimonials in public, request feedback, enable user-to-user communication, manage accounts, to send administrative information to you, send promotional material to you, to run and protect our business and platform services, to further our business interests, to investigate and make sure our platform is running smoothly without any policy violations. More specifically, we may need to process your data or share your personal information in the following situations:

 

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

  • Google Maps Platform APIs. We may share your information with certain Google Maps Platform APIs (e.g., Google Maps API, Place API). To find out more about Google’s Privacy Policy, please refer to this link. We obtain and store on your device ('cache') your location. You may revoke your consent anytime by contacting us at the contact details provided at the end of this document.

  • Vendors, Consultants and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: payment processing, data analysis, email delivery, hosting services, customer service and marketing efforts. We may allow selected third parties to use tracking technology on the Website/platform, which will enable them to collect data on our behalf about how you interact with our platform over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content, pages or features, and better understand online activity.

  • Other Users. When you share personal information (for example, by posting comments, contributions or other content to the Website) or otherwise interact with public areas of the Website/platform, such personal information may be viewed by all users and may be publicly made available outside the Website in perpetuity. If you interact with other users of our Website and register for our Website through a social network (such as Facebook), your contacts on the social network will see your name, profile photo, and descriptions of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you within our Website, and view your profile.

HOW DO WE HANDLE YOUR SOCIAL LOGINS?     

 

In Short:  If you choose to register or log in to our services using a social media account, we may have access to certain information about you.

 

Our Website may offer you the ability to register and login using your third-party social media account details (like your Facebook or Twitter logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, friends list, profile picture as well as other information you choose to make public on such social media platform. 

 

We will use the information we receive only for the purposes that are described in this privacy notice or that are otherwise made clear to you on the relevant Website. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their privacy notice to understand how they collect, use and share your personal information, and how you can set your privacy preferences on their sites and apps.

 

HOW LONG DO WE KEEP YOUR INFORMATION?

 

In Short:  We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.

 

To request a deletion of an account, users can email us a request at support@moodliftapp.com or delete their account from within the app.

Privacy and Data Security Commitment

At Curomates or Moodlift, user privacy is a top priority. We adhere to stringent data security measures to prevent any form of unauthorized disclosure. Our platform empowers users and service providers ("listeners") to control their information, deciding what to share and what to keep private.

  • Any personal data shared is shared voluntarily by the users or listeners. Moodlift may at times check the contents of chats/calls/video calls on its platform to enforce rules and try to maintain a safe platform for all parties using our services. By using any of our services, you agree to not divulge any private information about yourself or others, and not to harass any individual or groups. You also must hold us unaccountable for any information shared among users, listeners or groups on the platform.

  • Your email or phone number is not visible to other users of the platform.

  • We only collect minimal user information (e.g., name, age, email ID etc) necessary for account registration.

  • No messages are sent without user consent.

  • Moodlift may use your signup details to reach out to with promotional material outside of the app, or to conduct surveys (such as via calls or WhatsApp messages), etc) To opt out of promotional material or surveys, users can mail us at support@moodliftapp.com

  • User data may be used to enhance user experience with their consent.

  • All collected data is stored securely, preventing leaks or misuse.

Curomates does not collect, store, or process sensitive personal data beyond legally permissible parameters. Users are encouraged not to share sensitive information within the platform, with anyone at all.

Data Collection and Usage

Curomates may collect user information when individuals interact with our platform, including inquiries, registration, or service usage. Data collected may include:

  • Name, email, phone number, and basic profile information.

  • User preferences for service personalization.

  • Necessary details for account creation and authentication.

While Curomates serves as a platform connecting users and listeners, we are not responsible for any interactions between them. However, we try to implement extensive measures to safeguard privacy and security. Users and listeners are individually responsible for maintaining each other’s confidentiality. No listeners are an employee of Moodlift’s. While we try to onboard good listeners who can help make a positive difference, Moodlift cannot verify or be held accountable for the profiles, views, comments or behavior of listeners or any users on our platform.

However, Moodlift as per law, is legally bound to disclose information that any government organization with proper instructions from the court of law, in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by law.

Moodlift as far as its publishing and online involvement is concerned, is only an intermediary as defined under the “Information Technology Act, 2000” and “Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021”, and does not modify and edit or in any way manipulate user-generated contents (if any), and therefore, is protected under law.

Information Collection & Use

In our ads, we may state that conversations or calls are 100% private. We mean that your personal information which is your real name and phone number is not shared with other app users or listeners, however as stated in the privacy policy, we ourselves may observe the contents of these chats or calls for all the reasons listed in this privacy policy.

Moodlift may collect certain information to operate, enhance, and promote our services when you install, access, or use our platform. The type of data we collect depends on how you engage with our services.

When you sign up, inquire about, or use Moodlift’s services via our website or mobile application, we may request some basic identification details with your consent. This includes your name, email, phone number, preferences etc.

 

Important Policy Considerations

  • Curomates is not a medical service provider and does not offer certified medical or psychological advice.

  • Any sensitive or medical information shared is at the user's discretion and will be protected as far as reasonably possible.

  • Curomates may update this policy(or any of its other policy’s)  at any time without prior notice while continuing to prioritize data security and privacy. If you use any of our services at any point, you agree to the updated Terms of Service, Privacy Policy and Refund Policy in full, at all points of time.

  • We are not liable for the voluntary exchange of information between users and listeners and any subsequent outcomes. We only connect third-party entities on our platform (listeners are not employees), and cannot be held responsible for the interactions between any individuals or groups on our platform, and any subsequent consequences or events. We do not take any responsibility for any personal content shared on our platform, and strongly encourage users against giving anyone any personal details. As stated, Moodlift is not a medical app, and if you are in crisis or in danger of harming yourself or others, please seek professional help. Moodlift is NOT A CRISIS HELPLINE.

Payments and Financial Transactions

When users make payments via Curomates, we process only essential transaction details, including:

  • Payment account details necessary for transaction completion.

  • Payment method, transaction amounts, and bank information.

  • We do not store or retain debit card numbers, expiry dates, PINs, OTPs, or BHIM UPI PINs.

  • All payment processing follows the security protocols of National Payments Corporation of India (NPCI).

  • Users may manage, modify, or delete their payment details via the platform settings.

  • If you would like to manage, change, limit, or delete your payment information, we allow you to do that through your Payments settings or by deleting your account.



 

Service Limitations

Curomates does not provide emergency services, such as access to police, fire, medical personnel, or hospitals. Users must independently arrange access to emergency assistance in their respective locations. Our services are limited to non-certified discussions, general guidance, and advisory interactions.

Disclaimer of Liability

  • Our services are provided on an "as-is" basis without warranties of any kind, including but not limited to merchantability, fitness for a particular purpose, title, non-infringement, or absence of harmful components.

  • We do not guarantee uninterrupted, error-free, or fully secure service operation.

  • Curomates does not control how users engage with the platform and is not responsible for user actions, third-party interactions, or shared content.

  • Users release Curomates, its affiliates, officers, directors, and employees from any disputes, claims, or damages arising from interactions with third parties.

Indemnification

Users and listeners agree to indemnify and hold Curomates, its employees, and directors harmless from any liabilities, damages, losses, or legal costs arising from platform usage, third-party claims, or disputes.

Dispute Resolution and Governing Law

  • Any disputes related to Curomates shall fall under the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

  • Governing law shall be Indian law.

  • Disputes will be resolved via arbitration, with a sole arbitrator mutually appointed or designated by the Federation of Indian Chambers of Commerce & Industry (FICCI).

  • The arbitrator shall be a qualified lawyer, retired High Court judge, or senior government official.

  • Arbitration fees shall be capped according to the model fee structure in the Arbitration and Conciliation Act, 1996, with proceedings conducted in English.

  • Users outside India agree that any disputes are governed by Indian law and fall under the jurisdiction of Mumbai courts.

By using Curomates/Moodlift, you agree to these terms and acknowledge that they form a legally binding contract between you and Curomates Enterprise Private Limited.
