We, Curomates Enterprise Private Limited ("Curomates"), operate the mobile application "Moodlift." Throughout this document, "we," "us," the "website," and "our" refer to Curomates and its platform Moodlift, while "you" and "users" refer to individuals accessing our services. This document sets forth the terms governing your use of Moodlift’s services.

Service Overview
Moodlift provides access to specific features and content through a subscription or one-time payments ("Membership Services"). Your use of these services, including any transactions, is subject to the following terms.

By downloading, accessing, or using the Moodlift app via any platform or medium, you agree to these Terms of Service.

These terms must be read alongside our Privacy Policy, and both documents are legally binding.

Moodlift operates under Indian law, with any disputes subject to the jurisdiction of Mumbai, Maharashtra, India.
If you continue to use Moodlift beyond this point, it is understood that you have read, understood, and accepted these terms in full. Any person using the app on your behalf is also bound by these terms.

Role of Listeners and Platform Limitations

"Listeners" on Moodlift are individuals who engage in discussions with users. Moodlift only facilitates these conversations and does not employ listeners or verify their credentials beyond basic checks.

Moodlift is a platform for discussions only. We do not provide medical, psychological, or professional advice.

Listeners operate independently and are solely responsible for their statements, conduct, and suggestions. Moodlift disclaims liability for any misrepresentation or advice provided by listeners.

Users should seek professional help for medical, psychological, or emergency concerns. Moodlift does not provide crisis intervention services and is not a substitute for professional help.

User Responsibilities

Users should avoid sharing sensitive personal information within the platform to maintain privacy.

Conversations on Moodlift are meant to be anonymous. Users should refrain from attempting to contact listeners outside of the platform.

Any disputes arising from interactions with listeners must be reported to Moodlift, but we are not liable for outcomes stemming from these discussions.

Users are responsible for their actions and any consequences arising from their conversations on Moodlift.

Moodlift does not take responsibility for any actions, self-harm, or legal consequences arising from user decisions. We provide a platform for discussions only and do not control the conduct of any party involved.

Changes to Membership Services

Moodlift reserves the right to:

Modify, suspend, or discontinue any part of the Membership Services without prior notice.

Restrict access to certain features or services.

Adjust pricing or introduce new service offerings at our discretion.

Remove content that violates our policies or is otherwise deemed inappropriate.

Anti-Hacking & Security Policy

Users must not:

Use Moodlift for any illegal purpose or in violation of any law.

Employ automated tools (e.g., bots, scrapers) to extract data or manipulate the platform.

Attempt unauthorized access to Moodlift’s data, servers, or accounts.

Interfere with platform security or operational integrity.

Record or distribute conversations occurring within the app.

Be below 18 years of age.

Moodlift reserves the right to terminate access to users violating these provisions and may pursue legal action where necessary.

Payments and Refunds

Moodlift does not provide refunds for Membership Services or Wallet Recharges.

Users agree that the listeners connect with members on their own volition, and when they choose to do so. Moodlift cannot guarantee that a particular listener will respond to a users chat or audio/video call request.

Users agree to pay all applicable fees associated with their membership.

International users are responsible for currency conversion fees and applicable taxes.

Disclaimers & Limitation of Liability

Moodlift is provided "as is" without warranties regarding uninterrupted service, accuracy, or fitness for a particular purpose.

We are not liable for:

Any loss, harm, or damage resulting from user interactions.

Service disruptions, errors, or data breaches.

The actions of listeners or any third-party entities.
-
Users acknowledge that they use Moodlift at their own risk.

Dispute Resolution & Governing Law

Any disputes must be settled via arbitration in Mumbai, India, in accordance with the Arbitration and Conciliation Act, 1996.

The arbitration will be conducted in English by a sole arbitrator appointed through FICCI.

Users outside India agree that Indian law governs these terms and that Mumbai courts have jurisdiction over disputes.

Changes to These Terms

Moodlift may update these Terms of Service at any time. Continued use of the platform constitutes acceptance of any modifications.
